Producer terms
What TONEHOLD and a producer agree when a house opens. Short, and in plain words.
Who
TONEHOLD is run by IFAH Instruments, SIRET 819 907 973 00013 (“we”). You are a producer, artist, studio or label accepted into the catalogue, and you use TONEHOLD for your music work. These are terms between professionals.
The founding year
€129 opens your House for one year from your first release, not from the day you pay. Asked within five days of paying, it is refunded in full. It is the price by invitation, before TONEHOLD opens to the public, for the founding houses. From your second year, and for a producer who joins once TONEHOLD is open, a year is €160.
It holds your House under your name, three productions prepared and published with their covers, their credits and their licence options, one playable sampler, licensing and checkout, a personal call to set up your House, and a place in the catalogue. We take no commission. A room made for you is quoted on request, apart from the founding year. Your House is out within two weeks of the day your productions arrive.
To decide: what becomes of a House whose year has ended and is not renewed, and what a further production costs to prepare.
Your work stays yours
Your masters, your copyright and your publishing remain yours. You give us one thing: the right to host, show, preview, license and deliver your productions on TONEHOLD: each production to four artists at most, or to one alone, as you choose, at the price you set (€450 where you set none). It is not exclusive, and it ends when you close your House, except for the licences already granted and the copies already sold.
What you promise
The work is yours, or cleared: its samples, its co-authors, its featured artists. You are free to grant the right above. If someone claims otherwise, we may take the release off sale while it is settled.
Selection
Every application is listened to and answered personally, and each release is looked at the same way. We may decline a release that does not fit what a copy can hold, or that raises a question of rights.
Your sales
You keep what your licences bring: we take no commission on your sales. What the payment processor takes on each payment is not ours, and comes off what you receive; tax, where it applies, is shown on every sale.
To decide: when and how you are paid what your licences brought, and what its statement shows. For the seller’s accountant: how a licence sold by IFAH Instruments and passed on whole is recorded.
A copy sold stays sold
Whoever holds a copy keeps it and can go on playing it, even after you close your house or these terms end.
Holders
The addresses of the people who hold your copies stay with us. You reach them through a signal: a message to everyone who holds a copy.
To confirm: how often a signal may be sent.
Ending
You may close your house whenever you wish. We may close it for a serious breach of these terms.
To decide: whether any part of the year is returned when a house closes early.
Law
For a lawyer: the governing law and the court, the limits of each side’s liability, and how these terms may change.
